The Supreme Court on Tuesday fixed January 18 for hearing two petitions, seeking stay on the High Court verdict declaring illegal the fifth amendment to the Constitution, at its full bench.
Appellate Division Chamber Judge Md Mojammal Hossain fixed the date for hearing the two separate stay petitions filed by BNP secretary general and three SC lawyers.
On Monday, BNP Secretary General Khandakar Delwar Hossain and three SC lawyers– Tajul Islam, Kamruzzaman Bhuiyan and Munshi Ahsan Kabir–filed the petitions with the apex court seeking reinstatement of the stay on the HC judgement.
The fifth amendment had legitimised all governments that had been in power following the coup of August 15, 1975 till April 9, 1979 including late president Ziaur Rahman’s ascension to the presidency, and included Bismillah-Ar-Rahman-Ar-Rahim in the preamble of the constitution.
Earlier on Sunday, the Appellate Division lifted its four-year-old stay order on the HC verdict and fixed January 18 for hearing the two pending leave-to-appeal petitions filed against the verdict.
The BNP secretary general and the three lawyers on May 4 last year filed the leave-to-appeal petitions with the apex court challenging the HC verdict.
